STOPTOBER Website - Privacy Policy

 

STOPTPBER is a public health campaign initiated by ASH and supported by the Ministry of Health.

 

Protecting the privacy and personal data of the visitors to the STOPTOBER website - www.stoptobernz.co.nz (Website) is of the utmost importance to us. This Privacy Policy (Policy) governs the collection and use of your Personal Information by us in connection with your access and use of the Website and is to inform you as a visitor to and/or user of the Website about what Personal Information we collect when you visit the Website, how we use the Personal Information, whether the Personal Information is disclosed and the ways in which we protect your privacy.

 

When you provide Personal Information to us, you are deemed to have consented to the collection, storage, disclosure, and use of your Personal Information by us in a manner disclosed in this Policy. 

 

We want you to feel secure when visiting the Website. We are committed to respecting your privacy.  However, if you do not agree to be bound by the Policy, please do not use the Website and provide Personal Information to us.

 

This Policy only covers the Website. It does not cover links within the Website to other websites.

 

In this Policy

·       you’ or ‘your’ means you as a user of the Website;

·       we’, ‘us’ and ‘our’ refers to ASH - Action on Smoking and Health, a New Zealand registered charity;

·       ‘Partners’ means our partners, sponsors, service providers and advertisers, and includes the Ministry of Health; and

1.           What is Personal Information?

 

As used in this Policy, the term ‘Personal Information’ means information that specifically identifies an individual (such as a name, address, telephone number, e-mail address, or other account number), and other details, including, without limitation, information about your  use of the Website.  Personal Information also includes demographic information such as date of birth, gender, geographic area and preferences when such information is linked to other personal information that identifies you.

 

Personal Information does not include ‘aggregate’ information, which is data we collect about the use of the Website or about a group or category of products, services or users, from which individual identities or other Personal Information has been removed.  In other words, information about how you use a service may be collected and combined with information about how others use the same service. Aggregate data helps us understand trends and our Website users' needs so that we can better develop our Website.  This Policy in no way restricts or limits our collection and use, including sharing with partners or third parties, of aggregate information.

 

2.           What Personal Information do we collect?

 

Personal Information may be collected indirectly and directly when you visit our Website. 

 

We may directly collect certain Personal Information you voluntarily provide to us when registering for sevice on the Website which may contain Personal Information. For example, we may collect Personal Information, such as your name, address, email, phone number, and other contact information when you request information, or send us an email or contact us by other means for any reason.  When we collect this type of information, we will notify you as to why we are asking for information and how this information will be used. It is completely up to you whether or not you want to provide it.

 

When you visit our Website, some information is also automatically collected, such as your computer's Internet Protocol (IP) address, the date and time of your visit and activity on the Website, your computer's browser type, the address of a referring website, and your activity on the Website.  We treat this information as Personal Information if we combine it with or link it to any of the identifying information mentioned above.  Otherwise, it is used in the aggregate only.

 

We may also automatically collect certain information through the use of  ‘cookies’.  Cookies are small data files that are stored on a user's hard drive at the request of a Website which save and retrieve information about your visit to our site - for example, how you entered and navigated through the Website and certain information such as your preferences and browsing history in relation to the Website. The cookies we use identify you merely as a number and do not contain any personal information. If you are logged into Facebook or other participating social media sites, for example, Tumblr, Pinterest, Twitter or YouTube, your user ID number will also be associated with the information mentioned above. 3.           How do we use the Personal Information?

 

In general, we use the Personal Information we collect to facilitate your use of, and our administration and operation of, the Website.  We may also use data for other purposes, which we would describe to you at the point we collect the information.

 

If you provide feedback on our Website we will only use it to develop and improve the Website. We will keep the actual feedback for six months after which it will be deleted but analysis of feedback may be kept.

 

If you provide Personal Information, for instance to order or access particular products or services, we may, from time to time contact you with extra support to help you, find out how useful our support has been or talk about ways in which our offering can be improved.

 

4.           Will we disclose your Personal Information to or share it with other organisations?

 

We may share Personal Information with third parties who are engaged by or working with us in connection with the operation of the Website and the services (Service Providers), and who need access to such information to carry out their work for us.

 

We may also share Personal Information in any manner with our Partners, who may use such information in the same way that we do (as described in this Policy).

In some cases, to better target our communications, we may share and use information held with other organisations, but this will only be done in an anonymous manner, which will not identify you.  Before you submit any Personal Information, we will notify you as to why we are asking for specific information and it is completely up to you whether or not you want to provide it.

 

While we only share your information with our Partners or Service Providers, when you visit pages on our site that display links to third party social media sites, for example, a Facebook Like button, Facebook or the relevant social media site will collect information about your visit. We do not sell Personal Information.

 

We may also disclose Personal information in the good faith belief that we are lawfully required to do so, or that doing so is reasonably necessary or appropriate to comply with the law or with legal process or authorities, respond to any claims, or to protect the rights of ASH, our users, our employees or the public, including without limitation to protect us or our users from fraudulent, abusive, inappropriate or unlawful use of our Website.

5.           Linking to Third Party Websites

 

The Website and any emails we may send may contain hyperlinks to other websites (Linked Sites).  Any Personal Information you provide on the Linked Sites is provided directly to that third party at your own risk and is subject to that third party's privacy policy.  We are not responsible for the content or privacy and security practices and policies of Linked Sites.  Hyperlinks from our Website to third party websites are provided for your convenience.  We encourage you to learn about their privacy and security practices and policies before providing such third party websites with any Personal Information.

 

6.           Protection and storage of Personal Information

 

ASH endeavours to:

·              take all reasonable steps to ensure Personal Information collected and used is accurate, complete and up to date;

·              destroy or permanently de-identify Personal Information if it is no longer needed for any purpose; and

·              protect your Personal Information from misuse, loss and unauthorised access, modification or disclosure.

 

Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable. 

 

We take appropriate steps to maintain the security of your Personal Information on our Website. You should understand that the open nature of the Internet is such that data may flow over networks without security measures and may be accessed and used by people other than those for whom the Personal Information is intended. Our intention is that this should not happen and we take measures to ensure that it does not.

You have the right to request access to your Personal Information in accordance with applicable privacy legislation.  You can ask for your Personal Information to be corrected if it is inaccurate, incomplete or out of date.
